caso de ainda n\u00e3o ter sido expedido mandado de pris\u00e3o, por tratar-se de infra\u00e7\u00e3o penal em que o r\u00e9u se livra solto ou por estar afian\u00e7ado, o juiz, ou o presidente da c\u00e2mara ou tribunal, se tiver havido recurso, far\u00e1 expedir o mandado de pris\u00e3o, logo que transite em julgado a senten\u00e7a condenat\u00f3ria.<\/p>\n<p>\u00a7 1 No caso de reformada pela superior inst\u00e2ncia, em grau de recurso, a senten\u00e7a absolut\u00f3ria, estando o r\u00e9u solto, o presidente da c\u00e2mara ou do tribunal far\u00e1, logo ap\u00f3s a sess\u00e3o de folhas, ser\u00e1 remetida ao diretor do estabelecimento em que tenha de ser cumprida a senten\u00e7a condenat\u00f3ria, e conter\u00e1:<\/p>\n<p>I \u2013 o nome do r\u00e9u e a alcunha por que for conhecido;<br \/>\nII \u2013 a sua qualifica\u00e7\u00e3o civil (naturalidade, filia\u00e7\u00e3o, idade, estado, profiss\u00e3o), instru\u00e7\u00e3o e, se constar, n\u00famero do registro geral do Instituto de Identifica\u00e7\u00e3o e Estat\u00edstica ou de reparti\u00e7\u00e3o cong\u00eanere;<br \/>\nIII \u2013 o teor integral da senten\u00e7a condenat\u00f3ria e a data da termina\u00e7\u00e3o da pena.<\/p>\n<p>Par\u00e1grafo \u00fanico. Expedida carta de guia para cumprimento de uma pena, se o r\u00e9u estiver cumprindo outra, s\u00f3 depois de terminada a execu\u00e7\u00e3o desta ser\u00e1 aquela executada. Retificar-se-\u00e1 a carta de guia sempre que sobrevenha modifica\u00e7\u00e3o quanto ao in\u00edcio da execu\u00e7\u00e3o ou ao tempo de dura\u00e7\u00e3o da pena.<\/p>\n<\/div>\n
