institu\u00edda no \u00e2mbito da empresa ser\u00e1 composta de, no m\u00ednimo, dois e, no m\u00e1ximo, dez membros, e observar\u00e1 as seguintes normas:<\/p>\n<p>I &#8211; a metade de seus membros ser\u00e1 indicada pelo empregador e outra metade eleita pelos empregados, em escrut\u00ednio,secreto, fiscalizado pelo sindicato de categoria profissional;<br \/>\nII &#8211; haver\u00e1 na Comiss\u00e3o tantos suplentes quantos forem os representantes t\u00edtulares;<br \/>\nIII &#8211; o mandato dos seus membros, titulares e suplentes, \u00e9 de um ano, permitida uma recondu\u00e7\u00e3o.<\/p>\n<p>\u00a7 1\u00ba \u00c9 vedada a dispensa dos representantes dos empregados membros da Comiss\u00e3o de Concilia\u00e7\u00e3o Pr\u00e9via, titulares e suplentes, at\u00e9 um ano ap\u00f3s o final do mandato, salvo se cometerem falta grave, nos termos da lei.<\/p>\n<p>\u00a7 2\u00ba O representante dos empregados desenvolver\u00e1 seu trabalho normal na empresa afastando-se de suas atividades apenas quando convocado para atuar como conciliador, sendo computado como tempo de trabalho efetivo o despendido nessa atividade.<\/p>\n<\/div>\n Qualquer demanda de natureza trabalhista ser\u00e1 submetida \u00e0 Comiss\u00e3o de Concilia\u00e7\u00e3o Pr\u00e9via se, na localidade da presta\u00e7\u00e3o de servi\u00e7os, houver sido institu\u00edda a Comiss\u00e3o no \u00e2mbito da empresa ou do sindicato da categoria.<\/p>\n<p>\u00a7 1\u00ba A demanda ser\u00e1 formulada por escrito ou reduzida a termo por qualquer dos membros da Comiss\u00e3o, sendo entregue c\u00f3pia datada e assinada pelo membro aos interessados.<\/p>\n<p>\u00a7 2\u00ba N\u00e3o prosperando a concilia\u00e7\u00e3o, ser\u00e1 fornecida ao empregado e ao empregador declara\u00e7\u00e3o da tentativa conciliat\u00f3ria frustrada com a descri\u00e7\u00e3o de seu objeto, firmada pelos membros da Comiss\u00e3o, que devera ser juntada \u00e0 eventual reclama\u00e7\u00e3o trabalhista.<\/p>\n<p>\u00a7 3\u00ba Em caso de motivo relevante que impossibilite a observ\u00e2ncia do procedimento previsto no caput deste artigo, ser\u00e1 a circunst\u00e2ncia declarada na peti\u00e7\u00e3o da a\u00e7\u00e3o intentada perante a Justi\u00e7a do Trabalho.<\/p>\n<p>\u00a7 4\u00ba Caso exista, na mesma localidade e para a mesma categoria, Comiss\u00e3o de empresa e Comiss\u00e3o sindical, o interessado optar\u00e1 por uma delas submeter a sua demanda, sendo competente aquela que primeiro conhecer do pedido.<\/p>\n<\/div>\n Esgotado o prazo sem a realiza\u00e7\u00e3o da sess\u00e3o, ser\u00e1 fornecida, no \u00faltimo dia do prazo, a declara\u00e7\u00e3o a que se refere o \u00a7 2\u00ba do art. 625-D.<\/p>\n<\/div>\n
