mais Sindicatos representativos de categorias econ\u00f4micas e profissionais estipulam condi\u00e7\u00f5es de trabalho aplic\u00e1veis, no \u00e2mbito das respectivas representa\u00e7\u00f5es, \u00e0s rela\u00e7\u00f5es individuais de trabalho.<\/p>\n<p>\u00a7 1\u00ba \u00c9 facultado aos Sindicatos representativos de categorias profissionais celebrar Acordos Coletivos com uma ou mais empr\u00easas da correspondente categoria econ\u00f4mica, que estipulem condi\u00e7\u00f5es de trabalho, aplic\u00e1veis no \u00e2mbito da empr\u00easa ou das acordantes respectivas rela\u00e7\u00f5es de trabalho.<\/p>\n<p>\u00a7 2\u00ba As Federa\u00e7\u00f5es e, na falta desta, as Confedera\u00e7\u00f5es representativas de categorias econ\u00f4micas ou profissionais poder\u00e3o celebrar conven\u00e7\u00f5es coletivas de trabalho para reger as rela\u00e7\u00f5es das categorias a elas vinculadas, inorganizadas em Sindicatos, no \u00e2mbito de suas class=\"article-box\">\n            <div class=\"article\"><p><strong>Art. 611-A.<\/strong> A conven\u00e7\u00e3o coletiva e o acordo coletivo de trabalho t\u00eam preval\u00eancia sobre a lei quando, entre outros, dispuserem sobre:<\/p>\n<p>I &#8211; pacto quanto \u00e0 jornada de trabalho, observados os limites constitucionais;<br \/>\nII &#8211; banco de horas anual;<br \/>\nIII &#8211; intervalo intrajornada, respeitado o limite m\u00ednimo de trinta minutos para jornadas superiores a seis horas;<br \/>\nIV &#8211; ades\u00e3o ao Programa Seguro-Emprego (PSE), de que trata a Lei no 13.189, de 19 de novembro de 2015;<br \/>\nV &#8211; plano de cargos, sal\u00e1rios e fun\u00e7\u00f5es compat\u00edveis com a condi\u00e7\u00e3o pessoal do empregado, bem como identifica\u00e7\u00e3o dos cargos que se enquadram como fun\u00e7\u00f5es de confian\u00e7a;<br \/>\nVI &#8211; regulamento empresarial;<br \/>\nVII &#8211; representante dos trabalhadores no local de trabalho;<br \/>\nVIII &#8211; teletrabalho, regime de sobreaviso, e trabalho intermitente;<br \/>\nIX &#8211; remunera\u00e7\u00e3o por produtividade, inclu\u00eddas as gorjetas percebidas pelo empregado, e remunera\u00e7\u00e3o por desempenho individual;<br \/>\nX &#8211; modalidade de registro de jornada de trabalho;<br \/>\nXI &#8211; troca do dia de feriado;<br \/>\nXII &#8211; enquadramento do grau de insalubridade;<br \/>\nXIII &#8211; prorroga\u00e7\u00e3o de jornada em ambientes insalubres, sem licen\u00e7a pr\u00e9via das autoridades competentes do Minist\u00e9rio do Trabalho;<br \/>\nXIV &#8211; pr\u00eamios de incentivo em bens ou servi\u00e7os, eventualmente concedidos em programas de incentivo;<br \/>\nXV &#8211; participa\u00e7\u00e3o nos lucros ou resultados da empresa.<\/p>\n<p>\u00a7 1\u00ba No exame da conven\u00e7\u00e3o coletiva ou do acordo coletivo de trabalho, a Justi\u00e7a do Trabalho observar\u00e1 o disposto no \u00a7 3o do art. 8o desta Consolida\u00e7\u00e3o.<\/p>\n<p>\u00a7 2\u00ba A inexist\u00eancia de expressa indica\u00e7\u00e3o de contrapartidas rec\u00edprocas em conven\u00e7\u00e3o coletiva ou acordo coletivo de trabalho n\u00e3o ensejar\u00e1 sua nulidade por n\u00e3o caracterizar um v\u00edcio do neg\u00f3cio jur\u00eddico.<\/p>\n<p>\u00a7 3\u00ba Se for pactuada cl\u00e1usula que reduza o sal\u00e1rio ou a jornada, a conven\u00e7\u00e3o coletiva ou o acordo coletivo de trabalho dever\u00e3o prever a prote\u00e7\u00e3o dos empregados contra dispensa imotivada durante o prazo de vig\u00eancia do instrumento coletivo.<\/p>\n<p>\u00a7 4\u00ba Na hip\u00f3tese de proced\u00eancia de a\u00e7\u00e3o anulat\u00f3ria de cl\u00e1usula de conven\u00e7\u00e3o coletiva ou de acordo coletivo de trabalho, quando houver a cl\u00e1usula compensat\u00f3ria, esta dever\u00e1 ser igualmente anulada, sem repeti\u00e7\u00e3o do ind\u00e9bito.<\/p>\n<p>\u00a7 5\u00ba Os sindicatos subscritores de conven\u00e7\u00e3o coletiva ou de acordo coletivo de trabalho dever\u00e3o participar, como litisconsortes necess\u00e1rios, em a\u00e7\u00e3o individual ou coletiva, que tenha como objeto a anula\u00e7\u00e3o de class=\"article-box\">\n            <div class=\"article\"><p><strong>Art. 611-B.<\/strong> Constituem objeto il\u00edcito de conven\u00e7\u00e3o coletiva ou de acordo coletivo de trabalho, exclusivamente, a supress\u00e3o ou a redu\u00e7\u00e3o dos seguintes direitos:<\/p>\n<p>I &#8211; normas de identifica\u00e7\u00e3o profissional, inclusive as anota\u00e7\u00f5es na Carteira de Trabalho e Previd\u00eancia Social;<br \/>\nII &#8211; seguro-desemprego, em caso de desemprego involunt\u00e1rio;<br \/>\nIII &#8211; valor dos dep\u00f3sitos mensais e da indeniza\u00e7\u00e3o rescis\u00f3ria do Fundo de Garantia do Tempo de Servi\u00e7o (FGTS);<br \/>\nIV &#8211; sal\u00e1rio m\u00ednimo;<br \/>\nV &#8211; valor nominal do d\u00e9cimo terceiro sal\u00e1rio;<br \/>\nVI &#8211; remunera\u00e7\u00e3o do trabalho noturno superior \u00e0 do diurno;<br \/>\nVII &#8211; prote\u00e7\u00e3o do sal\u00e1rio na forma da lei, constituindo crime sua reten\u00e7\u00e3o dolosa;<br \/>\nVIII &#8211; sal\u00e1rio-fam\u00edlia;<br \/>\nIX &#8211; repouso semanal remunerado;<br \/>\nX &#8211; remunera\u00e7\u00e3o do servi\u00e7o extraordin\u00e1rio superior, no m\u00ednimo, em 50% (cinquenta por cento) \u00e0 do normal;<br \/>\nXI &#8211; n\u00famero de dias de f\u00e9rias devidas ao empregado;<br \/>\nXII &#8211; gozo de f\u00e9rias anuais remuneradas com, pelo menos, um ter\u00e7o a mais do que o sal\u00e1rio normal;<br \/>\nXIII &#8211; licen\u00e7a-maternidade com a dura\u00e7\u00e3o m\u00ednima de cento e vinte dias;<br \/>\nXIV &#8211; licen\u00e7a-paternidade nos termos fixados em lei;<br \/>\nXV &#8211; prote\u00e7\u00e3o do mercado de trabalho da mulher, mediante incentivos espec\u00edficos, nos termos da lei;<br \/>\nXVI &#8211; aviso pr\u00e9vio proporcional ao tempo de servi\u00e7o, sendo no m\u00ednimo de trinta dias, nos termos da lei;<br \/>\nXVII &#8211; normas de sa\u00fade, higiene e seguran\u00e7a do trabalho previstas em lei ou em normas regulamentadoras do Minist\u00e9rio do Trabalho;<br \/>\nXVIII &#8211; adicional de remunera\u00e7\u00e3o para as atividades penosas, insalubres ou perigosas;<br \/>\nXIX &#8211; aposentadoria;<br \/>\nXX &#8211; seguro contra acidentes de trabalho, a cargo do empregador;<br \/>\nXXI &#8211; a\u00e7\u00e3o, quanto aos cr\u00e9ditos resultantes das rela\u00e7\u00f5es de trabalho, com prazo prescricional de cinco anos para os trabalhadores urbanos e rurais, at\u00e9 o limite de dois anos ap\u00f3s a extin\u00e7\u00e3o do contrato de trabalho;<br \/>\nXXII &#8211; proibi\u00e7\u00e3o de qualquer discrimina\u00e7\u00e3o no tocante a sal\u00e1rio e crit\u00e9rios de admiss\u00e3o do trabalhador com defici\u00eancia;<br \/>\nXXIII &#8211; proibi\u00e7\u00e3o de trabalho noturno, perigoso ou insalubre a menores de dezoito anos e de qualquer trabalho a menores de dezesseis anos, salvo na condi\u00e7\u00e3o de aprendiz, a partir de quatorze anos;<br \/>\nXXIV &#8211; medidas de prote\u00e7\u00e3o legal de crian\u00e7as e adolescentes;<br \/>\nXXV &#8211; igualdade de direitos entre o trabalhador com v\u00ednculo empregat\u00edcio permanente e o trabalhador avulso;<br \/>\nXXVI &#8211; liberdade de associa\u00e7\u00e3o profissional ou sindical do trabalhador, inclusive o direito de n\u00e3o sofrer, sem sua expressa e pr\u00e9via anu\u00eancia, qualquer cobran\u00e7a ou desconto salarial estabelecidos em conven\u00e7\u00e3o coletiva ou acordo coletivo de trabalho;<br \/>\nXXVII &#8211; direito de greve, competindo aos trabalhadores decidir sobre a oportunidade de exerc\u00ea-lo e sobre os interesses que devam por meio dele defender;<br \/>\nXXVIII &#8211; defini\u00e7\u00e3o legal sobre os servi\u00e7os ou atividades essenciais e disposi\u00e7\u00f5es legais sobre o atendimento das necessidades inadi\u00e1veis da comunidade em caso de greve;<br \/>\nXXIX &#8211; tributos e outros cr\u00e9ditos de terceiros;<br \/>\nXXX &#8211; as disposi\u00e7\u00f5es previstas nos arts. 373-A, 390, 392, 392-A, 394, 394-A, 395, 396 e 400 desta Consolida\u00e7\u00e3o.<\/p>\n<p>Par\u00e1grafo \u00fanico. Conven\u00e7\u00f5es e os Ac\u00f4rdos entrar\u00e3o em vigor 3 (tr\u00eas) dias ap\u00f3s a data da entrega dos mesmos no \u00f3rg\u00e3o referido neste artigo.<\/p>\n<p>\u00a7 2\u00ba C\u00f3pias recusar-se \u00e0 negocia\u00e7\u00e3o coletiva.<\/p>\n<p>\u00a7 1\u00ba Verificando-se recusa \u00e0 negocia\u00e7\u00e3o coletiva, cabe aos Sindicatos ou empr\u00easas interessadas dar ci\u00eancia do fato, conforme o caso, ao Departamento Nacional do Trabalho ou aos \u00f3rg\u00e3os regionais do Minist\u00e9rio do Trabalho e Previd\u00eancia Social, para convoca\u00e7\u00e3o compuls\u00f3ria dos Sindicatos ou empr\u00easas recalcitrantes.<\/p>\n<p>\u00a7 2\u00ba No caso de persistir a recusa \u00e0 negocia\u00e7\u00e3o coletiva, pelo desatendimento \u00e0s convoca\u00e7\u00f5es feitas pelo Departamento Nacional do Trabalho ou \u00f3rg\u00e3os regionais do Minist\u00e9rio de Trabalho e Previd\u00eancia Social, ou se malograr a negocia\u00e7\u00e3o entabolada, \u00e9 facultada aos Sindicatos ou empr\u00easas interessadas a instaura\u00e7\u00e3o de diss\u00eddio coletivo.<\/p>\n<p>\u00a7 3\u00ba Havendo conven\u00e7\u00e3o, acordo ou senten\u00e7a normativa em vigor, o diss\u00eddio coletivo dever\u00e1 ser instaurado dentro dos 60 (sessenta) dias anteriores ao respectivo termo final, para que o novo instrumento possa ter vig\u00eancia no dia imediato a esse termo.<\/p>\n<p>\u00a7 4\u00ba Nenhum processo de diss\u00eddio coletivo de natureza econ\u00f4mica ser\u00e1 admitido sem antes se esgotarem as medidas relativas \u00e0 formaliza\u00e7\u00e3o da com as respectivas empr\u00easas dar\u00e3o ci\u00eancia de sua resolu\u00e7\u00e3o, por escrito, ao Sindicato representativo da categoria profissional, que ter\u00e1 o prazo de 8 (oito) dias para assumir a dire\u00e7\u00e3o dos entendimentos entre os interessados, devendo igual procedimento ser observado pelas empr\u00easas interessadas com rela\u00e7\u00e3o ao Sindicato da respectiva categoria econ\u00f4mica.<\/p>\n<p>\u00a7 1\u00ba Expirado o prazo de 8 (oito) dias sem que o Sindicato tenha se desincumbido do encargo recebido, poder\u00e3o os interessados dar conhecimento do fato \u00e0 Federa\u00e7\u00e3o a que estiver vinculado o Sindicato e, em falta dessa, \u00e0 correspondente Confedera\u00e7\u00e3o, para que, no mesmo prazo, assuma a dire\u00e7\u00e3o dos entendimentos. Esgotado \u00easse prazo, poder\u00e3o os interessados prosseguir diretamente na negocia\u00e7\u00e3o coletiva at\u00e9 final.<\/p>\n<p>\u00a7 2\u00ba Para o fim de deliberar s\u00f4bre o Ac\u00f4rdo,
