para represent\u00e1-los, com a finalidade de promover-lhes o entendimento direto com os empregadores.<\/p>\n<p>\u00a7 1\u00ba A comiss\u00e3o ser\u00e1 composta: (Inclu\u00eddo pela Lei n\u00ba 13.467, de 2017)<\/p>\n<p>I &#8211; nas empresas com mais de duzentos e at\u00e9 tr\u00eas mil empregados, por tr\u00eas membros;<br \/>\nII &#8211; nas empresas com mais de tr\u00eas mil e at\u00e9 cinco mil empregados, por cinco membros;<br \/>\nIII &#8211; nas empresas com mais de cinco mil empregados, por sete membros.<\/p>\n<p>\u00a7 2\u00ba No caso de a empresa possuir empregados em v\u00e1rios Estados da Federa\u00e7\u00e3o e no Distrito Federal, ser\u00e1 assegurada a elei\u00e7\u00e3o de uma comiss\u00e3o de representantes dos empregados por Estado ou no Distrito Federal, na atribui\u00e7\u00f5es:<\/p>\n<p>I &#8211; representar os empregados perante a administra\u00e7\u00e3o da empresa;<br \/>\nII &#8211; aprimorar o relacionamento entre a empresa e seus empregados com base nos princ\u00edpios da boa-f\u00e9 e do respeito m\u00fatuo;<br \/>\nIII &#8211; promover o di\u00e1logo e o entendimento no ambiente de trabalho com o fim de prevenir conflitos;<br \/>\nIV &#8211; buscar solu\u00e7\u00f5es para os conflitos decorrentes da rela\u00e7\u00e3o de trabalho, de forma r\u00e1pida e eficaz, visando \u00e0 efetiva aplica\u00e7\u00e3o das normas legais e contratuais;<br \/>\nV &#8211; assegurar tratamento justo e imparcial aos empregados, impedindo qualquer forma de discrimina\u00e7\u00e3o por motivo de sexo, idade, religi\u00e3o, opini\u00e3o pol\u00edtica ou atua\u00e7\u00e3o sindical;<br \/>\nVI &#8211; encaminhar reivindica\u00e7\u00f5es espec\u00edficas dos empregados de seu \u00e2mbito de representa\u00e7\u00e3o;<br \/>\nVII &#8211; acompanhar o cumprimento das leis trabalhistas, previdenci\u00e1rias e das conven\u00e7\u00f5es coletivas e acordos coletivos de trabalho.<\/p>\n<p>\u00a7 1\u00ba As decis\u00f5es da comiss\u00e3o de representantes dos empregados ser\u00e3o sempre colegiadas, observada a maioria simples.<\/p>\n<p>\u00a7 2\u00ba A comiss\u00e3o organizar\u00e1 sua atua\u00e7\u00e3o de forma class=\"article-box\">\n            <div class=\"article\"><p><strong>Art. 510-C.<\/strong> A elei\u00e7\u00e3o ser\u00e1 convocada, com anteced\u00eancia m\u00ednima de trinta dias, contados do t\u00e9rmino do mandato anterior, por meio de edital que dever\u00e1 ser fixado na empresa, com ampla publicidade, para inscri\u00e7\u00e3o de candidatura.<\/p>\n<p>\u00a7 1\u00ba Ser\u00e1 formada comiss\u00e3o eleitoral, integrada por cinco empregados, n\u00e3o candidatos, para a organiza\u00e7\u00e3o e o acompanhamento do processo eleitoral, vedada a interfer\u00eancia da empresa e do sindicato da categoria.<\/p>\n<p>\u00a7 2\u00ba Os empregados da empresa poder\u00e3o candidatar-se, exceto aqueles com contrato de trabalho por prazo determinado, com contrato suspenso ou que estejam em per\u00edodo de aviso pr\u00e9vio, ainda que indenizado.<\/p>\n<p>\u00a7 3\u00ba Ser\u00e3o eleitos membros da comiss\u00e3o de representantes dos empregados os candidatos mais votados, em vota\u00e7\u00e3o secreta, vedado o voto por representa\u00e7\u00e3o.<\/p>\n<p>\u00a7 4\u00ba A comiss\u00e3o tomar\u00e1 posse no primeiro dia \u00fatil seguinte \u00e0 elei\u00e7\u00e3o ou ao t\u00e9rmino do mandato anterior.<\/p>\n<p>\u00a7 5\u00ba Se n\u00e3o houver candidatos suficientes, a comiss\u00e3o de representantes dos empregados poder\u00e1 ser formada com n\u00famero de membros inferior ao previsto no art. 510-A desta Consolida\u00e7\u00e3o.<\/p>\n<p>\u00a7 6\u00ba Se n\u00e3o houver registro de candidatura, ser\u00e1 lavrada ata e convocada nova elei\u00e7\u00e3o no prazo 1\u00ba O membro que houver exercido a fun\u00e7\u00e3o de representante dos empregados na comiss\u00e3o n\u00e3o poder\u00e1 ser candidato nos dois per\u00edodos subsequentes.<\/p>\n<p>\u00a7 2\u00ba O mandato de membro de comiss\u00e3o de representantes dos empregados n\u00e3o implica suspens\u00e3o ou interrup\u00e7\u00e3o do contrato de trabalho, devendo o empregado permanecer no exerc\u00edcio de suas fun\u00e7\u00f5es.<\/p>\n<p>\u00a7 3\u00ba Desde o registro da candidatura at\u00e9 um ano ap\u00f3s o fim do mandato, o membro da comiss\u00e3o de representantes dos empregados n\u00e3o poder\u00e1 sofrer despedida arbitr\u00e1ria, entendendo-se como tal a que n\u00e3o se fundar em motivo disciplinar, t\u00e9cnico, econ\u00f4mico ou financeiro.<\/p>\n<p>\u00a7 4\u00ba Os documentos referentes ao processo eleitoral devem ser emitidos em duas vias, as quais permanecer\u00e3o sob a guarda dos empregados e da empresa pelo prazo de cinco anos, \u00e0 disposi\u00e7\u00e3o para
