empregador, e para a realiza\u00e7\u00e3o do qual este n\u00e3o concorreu, direta ou indiretamente.<\/p>\n<p>\u00a7 1\u00ba A imprevid\u00eancia do empregador exclui a raz\u00e3o de for\u00e7a maior.<\/p>\n<p>\u00a7 2\u00ba \u00c0 ocorr\u00eancia do motivo de for\u00e7a maior que n\u00e3o afetar subst\u00e2ncialmente, nem for suscet\u00edvel de afetar, em tais condi\u00e7\u00f5es, a for\u00e7a maior que determine a extin\u00e7\u00e3o da empresa, ou de um dos estabelecimentos em que trabalhe o empregado, \u00e9 assegurada a este, quando despedido, uma indeniza\u00e7\u00e3o na forma seguinte:<\/p>\n<p>I &#8211; sendo est\u00e1vel, nos termos dos arts. 477 e 478;<br \/>\nII &#8211; n\u00e3o tendo direito \u00e0 estabilidade, metade da que seria devida em caso de l\u00edcita, em caso de for\u00e7a maior ou preju\u00edzos devidamente comprovados, a redu\u00e7\u00e3o geral dos sal\u00e1rios dos empregados da empresa, proporcionalmente aos sal\u00e1rios de cada um, n\u00e3o podendo, entretanto, ser superior a 25% (vinte e cinco por cento), respeitado, em qualquer caso, o sal\u00e1rio m\u00ednimo da regi\u00e3o.<\/p>\n<p>Par\u00e1grafo \u00fanico.
