      <div class=\"article-box\">\n            <div class=\"article\"><p><strong>Art. 472.<\/strong> O afastamento do empregado em virtude das exig\u00eancias do servi\u00e7o militar, ou de outro encargo p\u00fablico, n\u00e3o constituir\u00e1 motivo para altera\u00e7\u00e3o ou rescis\u00e3o do contrato de trabalho por parte do empregador.<\/p>\n<p>\u00a7 1\u00ba Para que o empregado tenha direito a voltar a exercer o cargo do qual se afastou em virtude de exig\u00eancias do servi\u00e7o militar ou de encargo p\u00fablico, \u00e9 indispens\u00e1vel que notifique o empregador dessa inten\u00e7\u00e3o, por telegrama ou carta registrada, dentro do prazo m\u00e1ximo de 30 (trinta) dias, contados da data em que se verificar a respectiva baixa ou a termina\u00e7\u00e3o do encargo a que estava obrigado.<\/p>\n<p>\u00a7 2\u00ba Nos contratos por prazo determinado, o tempo de afastamento, se assim acordarem as partes interessadas, n\u00e3o ser\u00e1 computado na contagem do prazo para a respectiva termina\u00e7\u00e3o.<\/p>\n<p>\u00a7 3\u00ba Ocorrendo motivo relevante de interesse para a seguran\u00e7a nacional, poder\u00e1 a autoridade competente solicitar o afastamento do empregado do servi\u00e7o ou do local de trabalho, sem que se configure a suspens\u00e3o do contrato de trabalho. (Inclu\u00eddo pelo Decreto-lei n\u00ba 3, de 27.1.1966)<\/p>\n<p>\u00a7 4\u00ba O afastamento a que se refere o par\u00e1grafo anterior ser\u00e1 solicitado pela autoridade competente diretamente ao empregador, em representa\u00e7\u00e3o fundamentada com audi\u00eancia da Procuradoria Regional do Trabalho, que providenciar\u00e1 desde logo a instaura\u00e7\u00e3o do competente inqu\u00e9rito administrativo. O prazo a que se refere o inciso III do caput deste artigo ser\u00e1 contado a partir da data de nascimento do filho. class=\"article-box\">\n            <div class=\"article\"><p><strong>Art. 475.<\/strong> O empregado que for aposentado por invalidez ter\u00e1 suspenso o seu contrato de trabalho durante o prazo fixado pelas leis de previd\u00eancia social para a efetiva\u00e7\u00e3o do benef\u00edcio.<\/p>\n<p>\u00a7 1\u00ba Recuperando o empregado a capacidade de trabalho e sendo a aposentadoria cancelada, ser-lhe-\u00e1 assegurado o direito \u00e0 fun\u00e7\u00e3o que ocupava ao tempo da aposentadoria, facultado, por\u00e9m, ao empregador, o direito de indeniz\u00e1-lo por rescis\u00e3o do contrato de trabalho, nos termos dos arts. 477 e 478, salvo na hip\u00f3tese de ser ele portador de estabilidade, quando a indeniza\u00e7\u00e3o dever\u00e1 ser paga na forma do art. 497.<\/p>\n<p>\u00a7 2\u00ba Se o empregador houver admitido substituto para o aposentado, poder\u00e1 rescindir, com este, o respectivo contrato de trabalho sem indeniza\u00e7\u00e3o, desde que tenha havido ci\u00eancia       <div class=\"article-box\">\n            <div class=\"article\"><p><strong>Art. 476-A.<\/strong> O contrato de trabalho poder\u00e1 ser suspenso, por um per\u00edodo de dois a cinco meses, para participa\u00e7\u00e3o do empregado em curso ou programa de qualifica\u00e7\u00e3o profissional oferecido pelo empregador, com dura\u00e7\u00e3o equivalente \u00e0 suspens\u00e3o contratual, mediante previs\u00e3o em conven\u00e7\u00e3o ou acordo coletivo de trabalho e aquiesc\u00eancia formal do empregado, observado o disposto no art. 471 desta Consolida\u00e7\u00e3o.<\/p>\n<p>\u00a7 1\u00ba Ap\u00f3s a autoriza\u00e7\u00e3o concedida por interm\u00e9dio de conven\u00e7\u00e3o ou acordo coletivo, o empregador dever\u00e1 notificar o respectivo sindicato, com anteced\u00eancia m\u00ednima de quinze dias da suspens\u00e3o contratual.<\/p>\n<p>\u00a7 2\u00ba O contrato de trabalho n\u00e3o poder\u00e1 ser suspenso em conformidade com o disposto no caput deste artigo mais de uma vez no per\u00edodo de dezesseis meses.<\/p>\n<p>\u00a7 3\u00ba O empregador poder\u00e1 conceder ao empregado ajuda compensat\u00f3ria mensal, sem natureza salarial, durante o per\u00edodo de suspens\u00e3o contratual nos termos do caput deste artigo, com valor a ser definido em conven\u00e7\u00e3o ou acordo coletivo.<\/p>\n<p>\u00a7 4\u00ba Durante o per\u00edodo de suspens\u00e3o contratual para participa\u00e7\u00e3o em curso ou programa de qualifica\u00e7\u00e3o profissional, o empregado far\u00e1 jus aos benef\u00edcios voluntariamente concedidos pelo empregador.<\/p>\n<p>\u00a7 5\u00ba Se ocorrer a dispensa do empregado no transcurso do per\u00edodo de suspens\u00e3o contratual ou nos tr\u00eas meses subseq\u00fcentes ao seu retorno ao trabalho, o empregador pagar\u00e1 ao empregado, al\u00e9m das parcelas indenizat\u00f3rias previstas na legisla\u00e7\u00e3o em vigor, multa a ser estabelecida em conven\u00e7\u00e3o ou acordo coletivo, sendo de, no m\u00ednimo, cem por cento sobre o valor da \u00faltima remunera\u00e7\u00e3o mensal anterior \u00e0 suspens\u00e3o do contrato.<\/p>\n<p>\u00a7 6\u00ba Se durante a suspens\u00e3o do contrato n\u00e3o for ministrado o curso ou programa de qualifica\u00e7\u00e3o profissional, ou o empregado permanecer trabalhando para o empregador, ficar\u00e1 descaracterizada a suspens\u00e3o, sujeitando o empregador ao pagamento imediato dos sal\u00e1rios e dos encargos sociais referentes ao per\u00edodo, \u00e0s penalidades cab\u00edveis previstas na legisla\u00e7\u00e3o em vigor, bem como \u00e0s san\u00e7\u00f5es previstas em conven\u00e7\u00e3o ou acordo coletivo.<\/p>\n<p>\u00a7 7\u00ba O prazo limite fixado no caput poder\u00e1 ser prorrogado mediante conven\u00e7\u00e3o ou acordo coletivo de trabalho e aquiesc\u00eancia formal do empregado, desde que o empregador arque com o \u00f4nus correspondente ao valor da bolsa de qualifica\u00e7\u00e3o profissional, no respectivo per\u00edodo.<\/p>\n<\/div>\n
