401.<\/strong> Pela infra\u00e7\u00e3o de qualquer dispositivo deste Cap\u00edtulo, ser\u00e1 imposta ao empregador a multa de cem a mil cruzeiros, aplicada, nesta Capital, pela autoridade competente de 1\u00aa inst\u00e2ncia do Departamento Nacional do Trabalho, e, nos Estados e Territ\u00f3rio do Acre, pelas autoridades competentes do Minist\u00e9rio do Trabalho, Industria e Comercio ou por aquelas que exer\u00e7am fun\u00e7\u00f5es delegadas.<\/p>\n<p>\u00a7 1\u00ba A penalidade ser\u00e1 sempre aplicada no grau m\u00e1ximo:<br \/>\na) se ficar apurado o emprego de artif\u00edcio ou simula\u00e7\u00e3o para fraudar a aplica\u00e7\u00e3o dos dispositivos deste Cap\u00edtulo;<br \/>\nb) nos casos de reincid\u00eancia.<\/p>\n<p>\u00a7 2\u00ba O processo na verifica\u00e7\u00e3o das infra\u00e7\u00f5es, bem como na aplica\u00e7\u00e3o e cobran\u00e7a das multas, ser\u00e1 o previsto no t\u00edtulo &#8220;Do Processo de Multas Administrativas&#8221;, observadas as
