      <div class=\"article-box\">\n            <div class=\"article\"><p><strong>Art. 249.<\/strong> Todo o tempo de servi\u00e7o efetivo, excedente de 8 (oito) horas, ocupado na forma do artigo anterior, ser\u00e1 considerado de trabalho extraordin\u00e1rio, sujeito \u00e0 compensa\u00e7\u00e3o a que se refere o art. 250, exceto se se tratar de trabalho executado:<\/p>\n<p>a) em virtude de responsabilidade pessoal do tripulante e no desempenho de fun\u00e7\u00f5es de dire\u00e7\u00e3o, sendo consideradas como tais todas aquelas que a bordo se achem constitu\u00eddas em um \u00fanico indiv\u00edduo com responsabilidade exclusiva e pessoal;<br \/>\nb) na imin\u00eancia de perigo, para salvaguarda ou defesa da embarca\u00e7\u00e3o, dos passageiros, ou da carga, a ju\u00edzo exclusivo do comandante ou do respons\u00e1vel pela seguran\u00e7a a bordo;<br \/>\nc) por motivo de manobras ou fainas gerais que reclamem a presen\u00e7a, em seus postos, de todo o pessoal de bordo;<br \/>\nd) na navega\u00e7\u00e3o lacustre e fluvial, quando se destina ao abastecimento do navio ou embarca\u00e7\u00e3o de combust\u00edvel e rancho, ou por efeito das conting\u00eancias da natureza da navega\u00e7\u00e3o, na transposi\u00e7\u00e3o de passos ou pontos dif\u00edceis, inclusive opera\u00e7\u00f5es de al\u00edvio ou transbordo de carga, para obten\u00e7\u00e3o de calado menor para essa transposi\u00e7\u00e3o.<\/p>\n<p>\u00a7 1\u00ba O trabalho executado aos domingos e feriados ser\u00e1 considerado extraordin\u00e1rio, salvo se se destinar:<br \/>\na) ao servi\u00e7o de quartos e vigil\u00e2ncia, movimenta\u00e7\u00e3o das m\u00e1quinas e aparelhos de bordo, limpeza e higiene da embarca\u00e7\u00e3o, preparo de alimenta\u00e7\u00e3o da equipagem e dos passageiros, servi\u00e7o pessoal destes e, bem assim, aos socorros de urg\u00eancia ao navio ou ao pessoal;<br \/>\nb) ao fim da navega\u00e7\u00e3o ou das manobras para a entrada ou sa\u00edda de portos, atraca\u00e7\u00e3o, desatraca\u00e7\u00e3o, embarque ou desembarque de carga e passageiros.<\/p>\n<p>\u00a7 2\u00ba N\u00e3o exceder\u00e1 de 30 (trinta) horas semanais o servi\u00e7o servi\u00e7o, por descanso em per\u00edodo equivalente no dia seguinte ou no subseq\u00fcente dentro das do trabalho normal, ou no fim da viagem, ou pelo pagamento do sal\u00e1rio
