teletrabalho ou trabalho remoto a presta\u00e7\u00e3o de servi\u00e7os fora das depend\u00eancias do empregador, de maneira preponderante ou n\u00e3o, com a utiliza\u00e7\u00e3o de tecnologias de informa\u00e7\u00e3o e de comunica\u00e7\u00e3o, que, por sua natureza, n\u00e3o configure trabalho externo.<\/p>\n<p>\u00a7 1\u00ba O comparecimento, ainda que de modo habitual, \u00e0s depend\u00eancias do empregador para a realiza\u00e7\u00e3o de atividades espec\u00edficas que exijam a presen\u00e7a do empregado no estabelecimento n\u00e3o descaracteriza o regime de teletrabalho ou trabalho remoto.<\/p>\n<p>\u00a7 2\u00ba O empregado submetido ao regime de teletrabalho ou trabalho remoto poder\u00e1 prestar servi\u00e7os por jornada ou por produ\u00e7\u00e3o ou tarefa.<\/p>\n<p>\u00a7 3\u00ba Na hip\u00f3tese da presta\u00e7\u00e3o de servi\u00e7os em regime de teletrabalho ou trabalho remoto por produ\u00e7\u00e3o ou tarefa, n\u00e3o se aplicar\u00e1 o disposto no Cap\u00edtulo II do T\u00edtulo II desta Consolida\u00e7\u00e3o.<\/p>\n<p>\u00a7 4\u00ba O regime de teletrabalho ou trabalho remoto n\u00e3o se confunde nem se equipara \u00e0 ocupa\u00e7\u00e3o de operador de telemarketing ou de teleatendimento.<\/p>\n<p>\u00a7 5\u00ba O tempo de uso de equipamentos tecnol\u00f3gicos e de infraestrutura necess\u00e1ria, bem como de softwares, de ferramentas digitais ou de aplica\u00e7\u00f5es de internet utilizados para o teletrabalho, fora da jornada de trabalho normal do empregado n\u00e3o constitui tempo \u00e0 disposi\u00e7\u00e3o ou regime de prontid\u00e3o ou de sobreaviso, exceto se houver previs\u00e3o em acordo individual ou em acordo ou conven\u00e7\u00e3o coletiva de trabalho.<\/p>\n<p>\u00a7 6\u00ba Fica permitida a ado\u00e7\u00e3o do regime de teletrabalho ou trabalho remoto para estagi\u00e1rios e aprendizes.<\/p>\n<p>\u00a7 7\u00ba Aos empregados em regime de teletrabalho aplicam-se as disposi\u00e7\u00f5es previstas na legisla\u00e7\u00e3o local e nas conven\u00e7\u00f5es e nos acordos coletivos de trabalho relativas \u00e0 base territorial do estabelecimento de lota\u00e7\u00e3o do empregado.<\/p>\n<p>\u00a7 8\u00ba Ao contrato de trabalho do empregado admitido no Brasil que optar pela realiza\u00e7\u00e3o de teletrabalho fora do territ\u00f3rio nacional aplica-se a legisla\u00e7\u00e3o brasileira, excetuadas as disposi\u00e7\u00f5es constantes da Lei n\u00ba 7.064, de 6 de dezembro de 1982, salvo disposi\u00e7\u00e3o em contr\u00e1rio estipulada entre as partes.<\/p>\n<p>\u00a7 9\u00ba Acordo individual poder\u00e1 dispor sobre os hor\u00e1rios e os meios de comunica\u00e7\u00e3o entre empregado e empregador, desde que assegurados os repousos instrumento de contrato individual de trabalho. (Reda\u00e7\u00e3o dada pela Lei n\u00ba 14.442, de 2022)<\/p>\n<p>\u00a7 1\u00ba Poder\u00e1 ser realizada a altera\u00e7\u00e3o entre regime presencial e de teletrabalho desde que haja m\u00fatuo acordo entre as partes, registrado em aditivo contratual. (Inclu\u00eddo pela Lei n\u00ba 13.467, de 2017) (Vig\u00eancia)<\/p>\n<p>\u00a7 2\u00ba Poder\u00e1 ser realizada a altera\u00e7\u00e3o do regime de teletrabalho para o presencial por determina\u00e7\u00e3o do empregador, garantido prazo de transi\u00e7\u00e3o m\u00ednimo de quinze dias, com correspondente registro em aditivo contratual.
